2. Eligibility

- "User Content" means any inputs you provide (prompts, parameters) and outputs generated for you. - To the extent permitted by applicable law, you own your User Content, including outputs generated for you. We do not claim ownership over your User Content.
5.2 Your License to Us
You grant AI Story Generator a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your User Content as necessary to operate, maintain, and improve the Service. We do not use your prompts or outputs to train our own models unless we explicitly state otherwise in the Privacy Policy or provide a separate consent mechanism.
5.3 Similarity and Originality
AI outputs may be similar to content generated for other users or available elsewhere due to shared patterns in training data or common ideas. We do not guarantee the originality, accuracy, or suitability of any output for your intended use. You are responsible for reviewing outputs, conducting appropriate checks (e.g., fact-checking, IP clearance), and ensuring compliance with applicable laws.
5.4 Responsibility for Your Use
You are solely responsible for the content you input, the outputs you choose to use, and any consequences arising from such use, including compliance with intellectual property laws and avoiding sensitive data submission.
6. Our Intellectual Property
The Service (including but not limited to software, UX, interfaces, designs, documentation, and infrastructure) is owned by AI Story Generator and its licensors and is protected by applicable intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted by implication or otherwise. You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code, except as permitted by law.

11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AI STORY GENERATOR OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above exclusions and limitations may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless AI Story Generator and its affiliates, officers, employees, agents, partners, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another.
13. Subscriptions and Payments
We do not currently offer paid subscriptions or accept payments. If we introduce paid features in the future, we will update these Terms and provide applicable pricing and payment terms.
14. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if necessary to protect the Service, our users, or the public. Upon termination, the rights granted to you under these Terms will immediately cease.
15. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by and construed in accordance with the laws of the State of California, U.S.A., without regard to its conflict of law principles. - Venue and Arbitration: Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in San Francisco County, California, in English, under the rules of the American Arbitration Association. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. - Injunctive Relief: Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property or confidential information. - Class Action Waiver: You and AI Story Generator agree that any proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
16. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and AI Story Generator regarding the Service and supersede any prior agreements. - Severability: If any provision is found unenforceable, the remaining provisions will remain in full force and effect. - No Waiver: Our failure to enforce any right or provision is not a waiver of such right or provision. - Assignment: You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction.
